On December 2, 2024, our current MLS® rules are being replaced with the new PropTx MLS® Rules. These changes unify the rules for all users of the PropTx MLS® System and it is essential that you familiarize yourselves with the new rules as we are expecting audits and enforcement once these take effect. To help you, here is a summary of the key changes, and you will also find the full rules attached to this email. Please read them and reach out to a member of the Leadership team with any questions. Key Changes
You can no longer include language in the remarks sections that require a Buyer/Buyer’s agent to verify information about your listing. You, as the listing agent, are solely responsible for the accuracy of all information in your listing, photos, and attachments.
Prior to reporting a sale, you have to edit your listing to reflect any changes to the inclusions/exclusions that were part of the agreement. For example, let’s say your listing has a grand piano and pool table that were not listed as inclusions. During negotiations, the Buyer is able to have them included with the sale. These two items must be added to in the inclusions field before the deal can be reported firm. You as an agent MUST do this BEFORE you submit to deal admin to do the status change.
If you are listing a property with an irregular lot size, you must report the frontage and the SMALLER of the two depth dimensions, and identify the lot as “irregular”.
There are new requirements for listing photos:
you must have at least one photo of the property; no placeholders saying “photo coming soon”
No digitally altered or AI images that do not accurately represent the property. You can still use virtual staging as long as it shows furniture that could realistically fit and doesn’t change any of the interior surfaces.
No images of surrounding amenities, like nearby parks, grocery stores, etc. If you are listing a condo, you can include photos of building amenities.
No people in images
No marketing messages
Aerial images must identify the listed property
The “Brokerage Remarks” section can only contain information that could impact a cooperating brokerage. The most likely example is something like a collateral agreement. Any information about seller directions will need to be included in a new “Offer Remarks” field.
Properties must be available for showings as soon as the listing hits the MLS. This is now extended to include properties that are sold conditionally. If you have Seller direction not to allow showings during the conditional period, that must be added to the listing.
For suspended listings, as soon as the property is unsuspended, a listing agent must contact anyone who tried to book showings during the suspension to let them know it is once again available for appointments.
Any status changes (sold, leased, sold/leased conditional, etc.) must be reported within ONE business day. For anything that requires a deposit, this is one day from confirmation of receipt of the funds from deal admin.
